This Safety Content Disclaimer (“Disclaimer”) governs the informational content provided by Rail Safety Weekly LLC (the “Company”) through its briefings and related materials (collectively, the “Content”). The Company references the traditions reflected in common industry rulebooks but does not copy, reproduce, or distribute any copyrighted rulebook text.

IN THE EVENT OF ANY CONFLICT BETWEEN THE CONTENT AND THE SUBSCRIBER’S OWN RULES OR APPLICABLE REGULATION, THE SUBSCRIBER’S RULES AND THE APPLICABLE REGULATION SHALL CONTROL.

4.1 The Subscriber is solely responsible for its own safety programs and for verifying that any practice conforms to its current rules and the regulations applicable to its operation. The Subscriber shall confirm the current version of any regulation, as regulations are subject to change.

5.1 THE COMPANY MAKES NO GUARANTEE OF ANY SPECIFIC SAFETY OR COMPLIANCE OUTCOME. TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY SHALL NOT BE LIABLE FOR ANY INCIDENT, INJURY, LOSS, PENALTY, OR DAMAGE ARISING OUT OF OR RELATING TO THE USE OF, OR RELIANCE UPON, THE CONTENT.
